Petitioner is aggrieved by the inordinate delay in Complaint Case No.3547 of 2022 which is the proceeding under Section 138 of the Negotiable Instruments Act pending before the learned Judicial Magistrate, 1st Court, Alipore. Records reflect that the application under Section 143A of the Negotiable Instruments Act was preferred before the learned Magistrate after the examination under Section 251 of the Code of Criminal Procedure were over.

Having considered that the case was initiated in the year 2022 and the fact that the application under Section 143A of the Negotiable Instruments Act is still pending, I direct the learned Judicial Magistrate, 1st Court, Alipore to dispose of the application under Section 143A of the Negotiable Instruments Act on the next date so fixed or within a month thereafter. Learned trial court would thereafter fix at least one date in every 60 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment be granted to either of the parties. All efforts be taken to conclude the trial at the earliest.

With the aforesaid observations, CRR 688 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
