65 26.02.2026 ss CRM (NDPS) 357 of 2026 In the matter of : An application for bail under section 439 of the Code of Criminal Procedure read with section 483 of BNSS, 2023 filed in connection with Chandrakona P.S. Case No. 369 of 2024 dated 09.11.2024 under sections 20(b)(ii)(c)/25 of the Narcotic Drugs and Psychotropic Substances Act.

Goswami ... ... for the petitioners Mr. Arijit Ganguly Ms. Pritha Paul ... ... for the State Learned advocate appearing for the petitioners submits that the subject matter of the case involves joint recovery from the possession of three accused persons to the tune of 21.360 kgs ganja. Petitioners are in custody for more than 16 months and after framing charge 5 witnesses have already been examined.

Learned advocate appearing for the State opposes the prayer for bail.

I have taken into account the totality of the circumstances including the quantum of seizure as well as the period of detention of the present petitioners. Having

considered the same, I am of the view further detention of the petitioners is unwarranted in the facts and circumstances of the case.

Accordingly, the prayer for bail of the petitioners is allowed.

The petitioners shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act cum Additional District and Sessions Judge, Paschim Medinipur. If on bail, the petitioners shall be physically present on each and every date fixed before the learned trial court and shall not leave the district of Paschim Medinipur without the prior permission of the learned Special Court.

Accordingly, CRM(NDPS) 357 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
