No. 29 KAUSHIK REJECTED C.R.M.(A) 790 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Chakdah Police Station Case No. 35 of 2023 dated 15.01.2023 under Sections 447/325/326/195A/506/34 of the Indian Penal Code.

And In Re : Krishnapada Ghosh @ Moni ...... petitioner Mr. Subhrojyoti Ghosh ....for the petitioner Mr. Avishek Sinha ....for the State Petitioner prays for anticipatory bail.

Materials in the case diary suggest that the petitioner is involved in the assault where, the mother-in-law of the petitioner suffered fracture injuries.

This incident took place after the petitioner being enlarged on bail in a proceedings, inter alia, under Section 498A of the Indian Penal Code, 1860.

Considering the gravity of the offence and the involvement of the petitioner in the incident, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 790 of 2023 is dismissed.
