(AD) 08.03.2022 C.R.M. (A) 1120 of 2022 Court No.29 In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Belda P.S. Case No.37 of 2022 dated 04/02/2022 under Sections 279/304 of the Indian Penal Code.
And (Rejected) In the matter of: - Buddhadev Maity ...petitioner.
Mr. Prasun Kumar Dutta, Ld. APP Mr. Subrato Roy ...for the State.
Petitioner seeks anticipatory bail.
None appears for the petitioner even in the second call. Learned Advocate appearing for the State draws the attention of the Court to the materials in the case diary. He submits that the petitioner was driving the vehicle recklessly in a crowded place causing the incident.
Considering the materials in the case diary, the gravity of the offence and the involvement of the petitioner therein, we are unable to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
C.R.M. (A) 1120 of 2022 is dismissed.
