Kausik (Allowed) CRM (M) 519 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bankura P.S. Case No. 51 of 2025 dated 17.02.2025 under section 124(1) and 109 of the BNS, 2023.

Learned advocate appearing for the petitioner has drawn the attention of the Court to the deposition of victim who has been examined as PW 1.

I have taken into account the evidence of the victim. Learned advocate for the State has opposed the prayer for bail, but I find a compromise petition has been marked as an exhibit in the learned Trial Court. The evidence of the victim and the materials which were collected in course of investigation are completely different.

However, having considered that on the evidence of such victim, the trial would be taken to its logical conclusion, I am of the view further detention of the petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed.

Accordingly, Petitioner, namely, Sujit Barui @ Raja shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Additional Sessions Judge, 1st Court, Bankura. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Bankura without the prior permission of the Learned Trial Court. Accordingly, CRM (M) 519 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
