This revisional application seeks expeditious disposal of Title Suit No.737 of 2021 pending before the learned Civil Judge (Junior Division), 2nd Court at Alipore as well as an application under Order I Rule 10 read with Section 151 of the Code of Civil Procedure, 1908 filed in connection therewith.

Having regard to the nature of the order proposed to be passed by this Court, direction for prior service of notice along with a copy of the revisional application on the opposite party nos.2 to 6 is not being made, however, the petitioner

shall remain obliged to serve a copy of the revisional application along with a copy of this order upon the opposite party nos.2 to 6 within a week from date.

Having heard the learned advocates appearing for the petitioner and the opposite party no.1 and having considered the materials on record, this revisional application is disposed of by requesting the learned Civil Judge (Junior Division), 2nd Court at Alipore to dispose of the application under Order I Rule 10 read with Section 151 of the Code of Civil Procedure, 1908 as expeditiously as the business of the learned Trial Court would permit, preferably within a period of one month from the next date fixed without granting any unnecessary adjournment to either of the parties. The learned Trial Court is further requested to take up the suit thereafter and dispose of the same as expeditiously as possible, preferably within a period of eight months from the date of the disposal of the said application under Order I Rule 10 read with Section 151 of the Code of Civil Procedure, 1908 without granting any unnecessary adjournment to either of the parties.

The instant revisional application being CO 647 of 2026 stands disposed of.

There shall be no order as to costs.

As submitted by Mr. Lakamani, since no affidavits have been called for, the allegations contained in the present revisional application shall be deemed not to have been admitted by the opposite parties. 7.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
