C.R.M. (DB) 641 of 2022 25.04.2022 Sl. 80 Court No.29 sourav (DO) In Re: - An application under Section 439(2) of the Criminal Procedure Code for cancellation of bail.

And In the matter of: Merina Bibi ....petitioner.

Ms. Afreen Begum ...for the petitioner.

Mr. Debabrata Chatterjee Mrs. Mansi Roy ...for the State.

Mr. Kallol Mondal Mr. Amanul Islam Mr. Sourav Mukherjee ...for the opposite party.

Petitioner prays for cancellation of the anticipatory bail granted on December 9, 2021 passed in CRM 7100 of 2021 by the co-ordinate bench. Learned advocate appearing for the petitioner refers to the post bail misconduct of the private opposite parties. She submits that a First Information Report was lodged inter alia, under Section 448/324/506/34 of the Indian Penal Code on December 13, 2021. State and the opposite parties are represented. It appears from the records made available to Court including the written instructions of the learned advocate for the State, that, the private opposite parties surrendered before the learned Court and was released on bail in respect of the First Information Report dated December 13, 2021. In such circumstances, we find no reason to cancel the anticipatory bail of the petitioner granted by the co-ordinate bench on December 9, 2021.

CRM (DB) 641 of 2022 is, therefore, disposed of. (Debangsu Basak, J.) (Bibhas Ranjan De, J.)
