Mr. Debayan Ghosh, Ms. Nurjahan Khatun ...for the petitioners In this application the petitioners have prayed for a direction upon the Court below for expeditious disposal of Special Case No.37 of 2022 presently pending before learned Judge, Special Court, Chanchal, Malda.

Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that a complaint alleging commission of offence under Section 376(D) of the IPC along with Section 6 of the Protection of Children from Sexual Offences Act, 2012 was initiated against the petitioner on 28th day of May, 2022. After completion of investigation police submitted charge sheet against the accused persons on 8th June, 2023. Thereafter, the charge was framed after 2 years on 25th day of July, 2025. Since framing of charge one year has already been passed but no witness has been examined so far on behalf of the prosecution. Prosecution proposes to examine 20 witnesses. Therefore, he prayed for a direction upon the Court below for expeditious disposal of the said proceeding.

Having considered submission made on behalf of the petitioner, I find that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite parties will have no cause to prejudice, and, as such, service of copy of application upon the opposite parties are dispensed with.

Having considered the submission made on behalf of the petitioner and that the trial of the said session case has been stalled for a period of one year after framing the charge, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice.

In view of above, the instant application being CRR 858 of 2026 is hereby disposed of with a direction upon the Court below to make his best endeavour to expedite the trial and to take all steps to conclude the entire proceeding preferably within a period of six months from the next date of hearing.
