The petitioner is the objector to the grant of probate of the alleged last Will and Testament of Susil Kumar Banik alias Sushil Kumar Banik.

The petitioner at the stage of argument sought recall of the P.W.-1, the executor of the said Will and P.W.-2, the attesting witness of the said Will for further cross-examination of the said witnesses.

The learned Trial Judge considering the stage at which the suit has reached dismissed the said application. This Court does not find any illegality and/or infirmity in the order impugned warranting interference. CO 627 of 2020 is dismissed. No order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance of all requisite formalities.
