In Re: An Application under Section 482 of the Code of Criminal Procedure, 1973 filed in connection with Shibpur Police Station Case No. 293/2005 dated 22.11.2005 under Section 135 of the Electricity Act.

Mr. Gupta, learned advocate appearing for the CESC/petitioner submits a communication of the Senior Deputy Manager (Loss Control Cell) which reflects that the CESC authority is not interested in pursuing Shibpur Police Station Case No. 293/2005 dated 22.11.2005 under Section 135 of the Electricity Act wherein the accused persons were discharged by the learned Special Court.

In view of the stand of the CESC authority, the earlier direction dated 04.05.2022 upon the State is dispensed with. Having regard to the intention expressed by the complainant of the case, the revisional application being CRR 219 of 2015 is deemed to be infructuous and accordingly, disposed of.

Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.

The communication of Senior Deputy Manager (Loss Control Cell) dated 18.05.2022 be kept on record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
