Petitioner filed this revisional application under Section 482 of the Code of Criminal Procedure, 1973 seeking quashing of proceeding of GR Case No.

367 of 2016 pending before the Court of learned Chief Judicial Magistrate, Darjeeling arising out of Sadar Women Police Station case No. 21 of 2016 dated 17.8.2016 under Sections 498A/323/506/34 of the Indian Penal Code .

Heard both sides and upon perusal of the report submitted by the State it appears that the accused Chandrakala Tamang were adjudged not guilty of the offences punishable under Sections 498A/323/506/34 of the Indian Penal Code and she was acquitted under Sections 248(1) of the Cr. P.C. by the learned Magistrate on 22nd June, 2017.

Under the above facts and circumstances, the instant criminal revisional application become infructuous.

Accordingly, CRR 417 of 2017 is , thus, dismissed being infructuous.

Let a copy of the order be communicated to the learned Court below for information and necessary action.

Urgent xerox certified copy of this order, if applied for, be given to the learned advocate for the parties on usual undertakings.
