For the State The grievance of the petitioner is directed against the failure of the respondent Distribution Company to remove an electric pole outside his premises. The respondent Distribution Company is represented and submits that the electric pole does not cause any disturbance or hindrance outside the premises of the petitioner.

In view of the disputed questions of facts which arise for consideration, I direct the respondent No. 4 being the concerned District Magistrate to consider the grievance of the petitioner and dispose of the same within a period of eight weeks from date.

The petitioner is directed to file a representation with the respondent No. 4 within a period of one week from date. The respondent No. 4 is directed to give a right of hearing to the petitioner and all the affected parties including the Distribution Company and dispose of the representation within the stipulated time period.

I make it clear that nothing in this order will be binding on the respondent no. 4 insofar as the merits of this case are concerned. The respondent No. 4 is directed to pass a reasoned order in disposing of the representation of the petitioner.

With the aforesaid directions, W.P.A. 4828 of 2021 is disposed of.

There shall be no order as to costs.

Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
