The present revisional application was preferred challenging the proceedings arising out of Dum Dum Police Station Case No.1027 dated 1.12.2014 under Sections 323/341/354B/504/506 of the Indian Penal Code. Records of the revisional application reflect that the same appeared on 24th February, 2015 when there was a direction for effecting service upon the opposite parties.
As none appeared on behalf of the State, Ms. Debjani Sahu, learned advocate, who ordinarily appears on behalf of the State, is directed to represent the State in this mater. Her appointment may be regularised by the concerned authorities. The petitioner approached this Court immediately after the case was registered for investigation and the investigation of the case was in progress. The grounds so assigned in the revisional application relate to question of facts of abuses being hurled by the petitioner at the instance of the complainant/opposite party no.2. As the petitioner approached the Court when the investigation of
the case was in progress, I am of the opinion that factual appreciation by this Court at a stage when investigation has already commenced is unwarranted in the facts and circumstances of the case.
Accordingly, CRR 223 of 2015 is dismissed.
