C.R.M. (A)1130 of 2022 (AD) 08.03.2022 Court No.29 ( Allowed) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Khanakul P.S. Case No. 194 of 2020 dated 18/08/2020 under Sections 147/148/149/323/354/379/436 of the Indian Penal Code, 1860 read with Sections 3 and 4 of the Explosive Substances Act.

Petitioner seeks anticipatory bail.

Learned Advocate appearing for the petitioner submits that the petitioner is standing on the same footing with that of the other co-accused who were granted anticipatory bail by the coordinate Benches of this Hon'ble Court in several applications for anticipatory bail.

Learned Advocate appearing for the State draws the attention of the Court to the materials in the case diary. Considering the gravity of the offence and the involvement of the petitioner therein and considering the fact that the other co-accuseds were granted anticipatory bail by the coordinate Benches of this Hon'ble Court and considering the fact that the police submitted charge sheet, we grant anticipatory bail to the

petitioner.

Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a Bond of Rs.10,000/-(Rupees Ten Thousand Only) with two sureties of like amount each to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner shall appear before the jurisdictional Court and pray for regular bail within four weeks from date and on further condition that the petitioner shall appear before the Court below on every date fixed for hearing.

The prayer for anticipatory bail of the petitioner is allowed. C.R.M.(A) 1130 of 2022 is disposed of.
