Court No.35.

I.T C.R.R 382 of 2016 Mirja Azizur @ Rahaman -Vs.- State of West Bengal & Anr.

None appears on behalf of the petitioner, though the matter is pending in the list for several days and has been called on regularly. Hence, without wasting much time the same is taken up for disposal.

This is a case by the petitioners with the prayer to quash the proceedings being CR Case No.683 of 2015 under Sections 494/497/323/506/379/34 of IPC, pending in the court of the Ld. Judicial Magistrate, 5th Court, Burdwan. Opposite party no.2 is the complainant in the trial court who lodged the complaint dated 3rd October, 2015, contending inter alia that the petitioner has falsely represented about his marital status and allured on the frivolous pretexts the opposite party no.2 to marry him while his earlier marriage was subsisting, she has also alleged of theft by the petitioner. Petitioner has contended in this revision that the grounds upon which the criminal case has been lodged against him are only frivolous and motivated. He has prayed for dismissal of the proceedings.

Record reveals that the nature of the offence as alleged against the petitioners is of sufficient gravity. Moreover, the

petitioner's contentions and grounds are not based upon cogent reasons or the legal principle.

Therefore, I do not find any merit in the present revision case and the revisional application being CRR 382 of 2016 is dismissed.
