The petitioners by way of filing this public interest litigation seek for a direction to restrain the respondent no.10 and her men and agents to enter into the land bearing Dag No.177/3774 (RS) at Mouza-33, Village Paschim Gobindapur, DistrictNadia. 2.

Learned Assistant Additional Advocate General submitted that a civil suit is pending in respect of the property in question.

In any event, the prayer sought for is against the private individual and, therefore, this writ petition

cannot be treated as public interest litigation nor a direction can be issued upon a private individual. 4.

With the above observation, this writ petition is dismissed as not maintainable.
