Mr. Sandipan Maity Ms. Hasi Jana ....for the petitioner Mr. Ashim Kumar Ganguly Mr. Bellal Sheikh ....for the State Mr. Raj Kumar Sain ....for the respondent nos. 7 & 9 Affidavit of service filed on behalf of the petitioner is taken on record.

Learned counsel appearing on behalf of the petitioner submits that the private respondents had come up with illegal construction over public land. The same is preventing ingress and egress to the petitioner's property.

Representation dated 3rd February, was made to the concerned authorities. But, the same has not been taken into consideration yet.

Learned counsel appearing on behalf of the respondent nos. 7 and 9 denies the allegations and submits that it is the petitioner who had encroached upon the said land.

Learned counsel appearing on behalf of the State submits that if a representation pending consideration, the same shall be considered in accordance with law. In view of the above, let the Sub-Divisional Officer, Haldia Sub-Division, Durgachak, Purba Medinipur consider the petitioner's representation dated 3rd February, 2025 in accordance with law and upon hearing all the interested parties as expeditiously as possible, preferably within eight weeks from the date of communication of this order.

It is clarified that the merits of the case have not been gone into.

With these observations, the writ petition is disposed of.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance.
