Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 9 months, charges have already been framed and 8 witnesses have already been examined. Earlier, bail of Sadhan Sarkar in CRM(M) 49 of 2026 was allowed as also in respect of the receiver of stolen property being Ram Shivaji Ghatge in CRM(M) 2220 of 2025 was allowed. However, the bail prayer of Pritam Debnath and Samir Roy were rejected as it was the said accused persons against whom materials surfaced in respect of the gold jewellery and Rs.18,000/- cash being recovered. So far as
the present petitioner is concerned, the only material which has been recovered is an iron rod.
Learned advocate for the State opposes the prayer for bail and submits that pursuant to the statement of the petitioner iron rod was recovered and he has an antecedent of a case under the NDPS Act.
Having regard to the complicity of the present petitioner and the period of detention, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. The petitioner, namely, Uttam Das shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Ranaghat, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the district of Nadia without prior permission of the learned trial court. Accordingly, CRM(M) 528 of 2026 is allowed.
