Das ... ... for the petitioner Mr. Anand Keshari Ms. Sanjita Sultana ... ... for the State Learned advocate appearing for the petitioner submits that 100 grams of brown sugar were recovered from the present petitioner and he is in custody for 223 days. Investigation has already been concluded and as such the petitioner may be released on bail on any stringent condition. Learned advocate appearing for the State opposes the prayer for bail and submits that 705 grams of brown sugar were recovered. Subsequently the test reflected diacetylmorphine. Co-accused persons are still absconding. Having considered that the quantum of seizure is of commercial quantity, the rigors under section 37 of the NDPS Act is attracted and as such the prayer for bail of the petitioner in CRM (NDPS) 365 of 2026 is rejected.
