The lady first filed her application on 11th August, 2021 which was not allowed by the District Inspector of Schools. Thereafter, the petitioner filed several other applications on different dates and her last application was on 22.01.2022.
The case of the petitioner, being a single teacher, is covered by the notification published in the Kolkata Gazette on January 3, 2022. The School Managing Committee followed the notification and sent the application of the teacher to the District Inspector of Schools immediately.
The District Inspector of Schools under the said notification dated 03.01.2022 is required to make one local arrangement but this is not a mandate on the District Inspector of Schools. If such local arrangement
is made, then such local arrangement will be intimated to the Commissioner of School Education by the District Inspector of Schools and the Commissioner of School Education shall inform the matter to the Chairman of the West Bengal Central School Service Commission. In this way the application would be processed.
Considering the present situation of the lady teacher with a two-year old child, I direct the District Inspector of Schools to make an all out effort for an alternative arrangement. If it is made, the case will follow the course, as has been laid down in the said notification gazetted on 03.01.2022.
I direct the District Inspector of Schools to intimate the result of his endeavour for one local arrangement after three months from the date of communication of this order to the petitioner by way of a written communication.
With this observation and direction, this writ application is disposed of.
