The appeal is directed against a judgement and/or order dated 8th October, 2015 passed by a Single Bench of this Court. By the impugned judgement and/or order the Court directed the appellant herein being West Bengal State Electricity Distribution Company Limited to consider the representation of the writ petitioner within a period of two months. Instead of doing so, the appellant has preferred the instant appeal.

This Court is of the view that since the Single Bench has not decided the matter conclusively, the appellant West Bengal State Electricity Distribution Company Limited may consider the representation of the writ petitioner by a reasoned order and dispose of the same in accordance with law within a period of one month from date.

It is submitted that the original writ petitioner, Sri Sunil Kumar Lahiri has died.

In these circumstances, let fresh representation be made by the wife of Sri Sunil Kumar Lahiri, namely, Sandhya Lahiri, within a period of ten days from date. 5.

If such representation as directed hereinabove is made by the wife of Sri Sunil Kumar Lahiri, let the same be disposed of by the appellant West Bengal State Electricity Distribution Company Limited with a reasoned order in accordance with law within a period of thirty days thereafter.

The reasoned order may be communicated to the wife of Sri Sunil Kumar Lahiri forthwith thereafter.

With the aforesaid direction, the instant appeal is disposed of.

Consequently, all connected pending applications, if any, are also disposed of.

There shall be no order as to costs.
