None appears for the State and the Panchayat despite service.

The petitioner alleges that the private respondents are raising unauthorised construction in his property without obtaining sanctioned plan from the concerned Panchayat. The representation submitted by the petitioner before the concerned authority is not in consonance with the averment in the writ petition. The petitioner seeks to submit a comprehensive representation before the concerned authority and prays for direction upon the authority to consider the same at the earliest.

Upon consideration of the submission made on behalf of the parties, the writ petition is disposed of with liberty to the petitioner to submit a comprehensive representation ventilating his grievance before the Pradhan, 6 no. Benai Gram Panchayat, being the 5th respondent herein, within two weeks from date. On receipt of such representation, the 5th respondent shall consider and dispose of the same within four weeks thereafter upon affording reasonable opportunity

of hearing to the petitioner and the private respondents, in accordance with law.

In the event the construction raised by the 5th respondent is found to be illegal/unauthorised, the concerned authority shall take necessary steps, in accordance with law.

The writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
