The application for anticipatory bail under Section 438 CrPC has been filed apprehending arrest in connection with Beliaghata P.S. Case No. 193 of 2020 dated 01.10.2020 under Sections 406/420/120B of the Indian Penal Code. Counsel for the petitioner submits that he has responded to the notice under Section 41A by a letter dated 28th January, 2021.

Counsel for the State submits that the petitioner should have been present before the investigating officer in terms of Section 41A and therefore the petitioner has not cooperated with the investigating authorities.

Hence, the application is liable to be dismissed.
