The petitioners seek anticipatory bail.
Learned advocate appearing for the petitioners submit that the principal accused was granted anticipatory bail. Charge-sheet was submitted. He submits that, some other accused persons obtained anticipatory bail. The petitioners are on the same footing as those persons who obtained anticipatory bail. Learned advocate appearing for the State submits that the petitioners are not similarly situated as the person who obtained anticipatory bail. The petitioners are absconding for a long period of time.
We have considered the case diary. Since the police has submitted charge-sheet, we are inclined to grant anticipatory bail to the petitioners.
Accordingly, we direct that in the event of arrest, the petitioners be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioners shall meet the Officer-in-charge of the concerned police station once in a month. CRM 1861 of 2021 is disposed of.
