The defendant in a suit for eviction of licencee being Title Suit No.384 of 2012 pending before the learned Civil Judge (Junior Division) at Haldia, District: Purba Medinipur is the petitioner of the instant application under Article 227 of the Constitution of India. The learned Trial Judge, by the order impugned, has refused to grant leave to petitioner to file additional written statement; by the subsequent pleadings, the petitioner had sought to make out a completely new case at the argument stage.

The learned Trial Judge under such circumstances has rightly refused to grant leave to the petitioner for filing the said additional written statement.

The order impugned therefore does not call for any interference.

CO 571 of 2024 is dismissed without any order as to costs.
