Banerjee) Mr. Raghunath Das Ms. Monalisa Das ...for the petitioners This application is at the instance of the plaintiffs in a suit for partition praying for a direction upon the learned Civil Judge (Sr. Division), 1st Court, Tamluk, Purba Medinipur to dispose of Title Suit No. 112 of 1991 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or their learned advocates representing them before the learned trial Judge.

From the order sheet appended to the civil revision application this Court finds that April 2, 2025 has been fixed for hearing of the application sunder Order 39 Rules 1 and 2 of the Code of Civil

Procedure and an application under Order 39 Rule 7 of the Code.

In view thereof, CO 652 of 2025 is disposed by requesting the learned Civil Judge (Sr. Division), 1st Court, Tamluk, Purba Medinipur to take up the hearing of the application under Order 39 Rules 1 and 2 and Order 39 Rule 7 of the Code of Civil Procedure on the next date fixed, i.e., on April 2, 2025 and to dispose of the same without granting any unnecessary adjournment to either of the parties. It will be open to the learned trial Judge to decide as to which of the aforesaid applications may be taken up first.
