Petitioners Mr. Shibaji Kumar Das Mr. Dipendu Sarkar Ms. Deblina De ...for the Petitioners The petitioners have assailed the order dated January 14, 2025 passed by the learned Additional Chief Judicial Magistrate, Bidhannagar, North 24 Parganas in connection with G.R.Case No. 1638 of 2024 directing issuance of warrant of arrest against them. Learned counsel for the petitioners submits that the petitioner were in custody in connection with the case and were granted bail by an order dated January 08, 2025 passed by the learned Sessions Judge, North 24 Parganas at Barasat. They were not aware of the next date, i.e. January 14, 2025 fixed before the learned Additional Chief Judicial Magistrate and the date was wrongly informed to them by their learned counsel as January 24, 2025.

Since the petitioners failed to appear before the learned Magistrate on that date, warrant of arrest was issued against them. The petitioners undertake to surrender before the learned Additional Chief Judicial Magistrate within 10 days from date. If the petitioners surrender before the learned Additional Chief Judicial Magistrate, Bidhannagar within 10 days from date, they shall be allowed to remain on the same bond.

In the event the petitioners fail to surrender before the learned Additional Chief Judicial Magistrate, Bidhannagar within the stipulated time frame, the learned Additional Chief Judicial Magistrate, Bidhannagar shall be at liberty to take necessary steps against the petitioners in accordance with law without further reference to this Court.

The order impugned dated January 14, 2025 passed by the learned Additional Chief Judicial Magistrate, Bidhannagar, North 24 Parganas in connection with G.R.Case No. 1638 of 2024 be stayed till March 10, 2025.

CRR No. 860 of 2025 is disposed of accordingly. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
