Mr. Billawadal Bhattacharya Mr. Anish Mukherjee Mr. Aditya Mondal ...for the petitioner Mr. Amitesh Banerjee, Sr. Standing Counsel Mr. Tarak Karan ...for the State The petitioner challenges a notice dated February 15, ssi Ct. 238 2024, issued against him by the Officer in Charge, Special Raid Case Section, T.P. Traffic Building. Mr. Billawadal Bhattacharya, learned advocate appearing for the petitioner submits that the notice was issued without any authority. He submits that the visit by a police personnel to the residence of the petitioner to serve the said notice undermined the prestige and dignity of the petitioner in society. He further submits that the notice does not disclose any provision of law justifying its issuance. Mr. Amitesh Banerjee, learned advocate appearing for the State, on the other hand, submits that since last year, the Traffic Department of Kolkata Police has witnessed a number of cases of vehicles speeding over 100 kilometers per hour. He explains that following Supreme Court Committee directives, the Police Department sought to sensitise the car

owners about the issue and as a part of the said endeavour, the notice was issued to the petitioner. He clarifies that the police are, however, not inclined to take any coercive steps following the said notice.

In view of the reasonable stance taken by the State, I am not inclined to pass any order in this matter. I only observe that the Officer in Charge, Special Raid Case Section shall not take any further steps following the said notice. Furthermore, the petitioner, to ensure his own safety and security, is advised to avoid over speeding of his vehicle in future.

With these observations, WPA 4293 of 2024 is disposed of.
