A senior citizen is before Court complaining that although the letter dated February 1, 2021 to the Officer-in-charge of Bhatpara P.S. discloses commission of a cognizable offence, the police did not take any steps thereon.

State and the private respondents are represented.

Learned advocate for the State submits that the disputes between the petitioner and the private parties relate to an immovable property. The police enquired into the complaint and submitted a prosecution under Section 107 of the Criminal Procedure Code.

Learned advocate for the private respondents submits that the petitioner is

presently staying with her daughter in a separate mess at the same premises. No incident as alleged in the letter dated February 1, 2021 took place. As noted above, a senior citizen is before Court. The complaint dated February 1, 2021 contains an allegation that one of the private respondents and his wife beat the petitioner up. That allegation, in my view, discloses commission of a cognizable offence.

In such circumstances, the police will register the letter dated February 1, 2021 as a first information report and will investigate thereon, in accordance with law.

Learned advocate for the petitioner submits that the petitioner is apprehending further trouble from his younger son and his wife. He seeks protection.

Since the petitioner as a senior citizen, it would be appropriate to direct the police to ensure that no harm befalls the petitioner as to her life and property.
