CRIMINAL MISCELLANEOUS JURISDICTION CRM (DB) 695 of 2025 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure, 1973 / Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, arising out of Chapra Police Station Case No.999/2023 dated 24.12.2023 under Sections 302/34 of the IPC, 1860 & Sections 25/27 of the Arms Act.

The petitioner claims parity with the co-accused who are on bail.
Learned counsel for the State opposes the prayer. In view of the fact that the petitioner is similarly circumstanced with the co-accused who have been granted bail earlier, this court is inclined to hold that the petitioner is entitled to the same benefit.
Accordingly, prayer for bail is allowed.
The petitioner, namely, Faraj Sk. shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand),
with two sureties of like amount each, one of whom must be local, to the satisfaction of learned Chief Judicial Magistrate, Krishnagar, Nadia subject to condition that he shall appear before the learned trial court on every date of hearing and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.
In the event the petitioner fails to appear before the learned trial court on any date without justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this court. The application for bail being CRM (DB) 695 of 2025 is, thus, disposed of.
All parties shall act on the server copies of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
