Ballygunge Police Station Case No. 122 of 2019 dated 2nd August, 2019 under Sections 498A/420/406/509/34 of the Indian Penal Code read with Sections 3 and 4 of the Dowry Prohibition Act was instituted against the petitioners on the basis of a written complaint submitted by the private opposite party. On conclusion of investigation police submitted charge sheet in the month of December, 2022. In the meantime, the good sense between the parties prevailed and the parties have settled their dispute out of Court. After filing of a joint petition for compromise the learned P.P.- in-charge was requested to obtain a report from the Investigating Officer to ascertain as to whether the compromise was made freely, voluntarily without any threat, coercion or undue influence.

Such report has been submitted by the Investigating Officer stating, inter alia, that the parties have voluntarily settled their dispute. In the said report it is stated that the petitioners are entitled to ornaments and gold coins seized by the Investigating Officer on 3rd September, 2019 by two separate seizure lists. Therefore, the above mentioned proceeding being Ballygunge Police Station Case No. 122 of 2019 dated 2nd August, 2019 be quashed. The seized ornaments be returned in favour of the persons from whom these were seized without executing any bond. The locker standing in the name of Mrs.

defreezed and the said Archita Bhagat is allowed to operate the said locker bearing No. 335 in Axis Bank, Kolkata Main Branch. With the above order the instant revision is disposed of. (Bibek Chaudhuri, J.)
