Islam ..for the petitioner Mr. Santanu Kumar Mitra, Senior Advocate Mr. Sudip Sarkar ..for the State Mr. Soumya Majumdar ..for the respondent no.5 After considering the report filed on behalf of the respondent no.2, it appears that the review petition filed by the employer (the respondent no.5) has been dismissed. On the dismissal of the review petition nothing remains pending before the Tribunal. The review application was dismissed on 12th March, 2024. The respondent no.4 is directed to proceed expeditiously with the certificate proceedings being Certificate Case No. 02 of 2023 without granting any unnecessary adjournment to the parties. The certificate case should be disposed of within a period of six months
from date. The parties including the Tribunal concerned shall act on the basis of a server copy of this order without insisting upon production of a certified copy thereof.
It is made clear that I have not gone into the merits of the matter and the Certificate Officer shall be free to decide of all the issues raised before him without being influenced in any matter whatsoever by any observation made in this order.
The writ petition is accordingly disposed of. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
