As none appears on behalf of the State, Mr. Anwar Hossain, who ordinarily appears on behalf of the State, was directed to represent the State.

His appointment may be regularised by the concerned authorities.

Having regard to the reasons so assigned by the learned court for the purpose of framing charge in a case where allegations were under Section 417/376/34 of the Indian Penal Code, I am of the opinion, that the learned court was perfect in segregating two accused persons, namely Ekbal Ahmed Kazi and Manjur Ahmed Kazi, and the role which has been played by them in connection with the alleged offences.

The document under Section 207 of the Code of Criminal Procedure has not been enclosed. Having regard to the opinion of the Investigating Officer, the reason assigned by the learned court and the charge which has been framed, I am of the opinion, that no interference is called for.

Accordingly CRR 266 of 2013 is dismissed.

Pending application, if any, is consequently disposed of.

Interim order, if any, is hereby vacated.
