Petitioners are aggrieved by the fact that inspite of the directions passed on 10.12.2024 in T.S. 338/2024, the Officer-in-Charge, Sagarpara Police Station did not take any action.

On the other hand learned advocate appearing for the private respondent nos. 4 to 6 submits that the petitioners themselves are confused regarding the issues to be canvassed in the writ petition.

I find that the learned Civil Judge (Junior Division), 1st Court, Berhampore, Murshidabad in T.S 338/2024 has already issued a show-cause upon the Officer-in-Charge, Sagarpara Police Station.

The State has only recorded a case being Sagarpara P.S. Case No. 30 of 2025 dated 15.01.2025.

Learned Civil Court in siesin of the T.S. 338/24 is directed that if it finds that there has been violation and/or flouting in respect of the orders passed on 25.09.2024 dated 12.11.2024 and the concerned Officerin-Charge is not cooperating in implementing the order of the Civil Court, the concerned Court will be at liberty to take appropriate steps against the Officer-in-Charge of Sagarpara Police Station in accordance with law. With the aforesaid observations WPA 4263 of 2025 is disposed of.

Report submitted by the State be kept with the record.

Copies of the report be handed over to both the parties.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
