It is submitted on behalf of the petitioner that he was not named in the FIR. He has been falsely implicated. Accordingly, he prays for anticipatory bail.

Learned Advocate for the State opposes the prayer for anticipatory bail and submits the miscreants had gone to the victim's residence in a car. Petitioner is the owner of the car. Stolen articles were recovered from inside the car and identified by the relations of the deceased.

We have considered the materials on record. One Mithun Chakraborty was found dead in his room. Various articles were seen strewn about. In course of investigation, co-accused were arrested. Complicity of the petitioner transpired. Investigation also reveals vehicle of the petitioner was used to take the miscreants to the place of occurrence. Stolen property was recovered from the vehicle which has been identified by relations of the deceased. The aforesaid incriminating

materials disclose complicity of the petitioner in the murder and robbery. In view of gravity of the offence, we are not inclined to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner stands rejected.
