State of West Bengal and others Mr. Jayanta Das, Ms. Soumita Ghosh ... for the petitioner.

1. The grievance of the petitioner is that the petitioner's mother, who was an employee in the Dr. B. C. Roy Memorial Hospital, which is a Government hospital, retired in the year 2007 and subsequently expired in 2013. She had enrolled under the West Bengal Health Scheme during her lifetime, which covered the medical expenses incurred by the deceased mother of the petitioner.

2. However, despite having presented several bills during her lifetime, the petitioner did not get any such amount. After the demise of the petitioner's mother, the said claims were reiterated on behalf of her heirs. However, even after several representations and assurances by the authorities, nothing has been disbursed to the petitioner.

3. Despite service, none appears for the respondents to refute the claim of the petitioner. Affidavit-of-service filed in Court today be kept on record.

4. WPA No. 4035 of 2022 is accordingly disposed of by directing the respondent nos.

2, 3 and 5 to ensure that the bills presented by the petitioner on behalf of his mother and by the petitioner's deceased mother during her lifetime under the West Bengal Health Scheme, be processed immediately.

5. Such assessment shall be concluded positively within three weeks from the date of communication of a server copy of this order to the aforesaid respondents. Immediately thereafter, the bills assessed to be due in that regard shall be disbursed to the petitioner on behalf of all the legal heirs of the deceased mother of the petitioner within three weeks thereafter.

6. It is made clear that the merits or veracity of the claims of the petitioner have not been entered into by this court and it will be open to the respondent authorities to assess the same independently without being influenced in any

manner by any of the observations made herein.

7. There will be no order as to costs.

8. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.)
