Ms. Sanjukta Samanta ....for the petitioner The petitioner complains that he is being pressurized to join a rival political party for a substantial period of time before December, 2022. He has left his residence out of threat and intimidation by the private respondent nos. 7 and 8 The Belda Police Station, Paschim Medinipur has filed a report dated 21.02.2023, which is taken on record.

It appears that one Smt. Gita Rani Roy, respondent no.7 has lodged a complaint against the petitioner on December 15, 2022, alleging that the petitioner and one Kalipada Roy and his wife Swapna Roy and one Banabihari Roy have assaulted her and tried to choke her with a pillow. Consequently, the Belda Police Station has registered FIR being Belda PS Case No.555/22 dated 16.12.2022 under Sections 448/323/307/379/506/34 of the IPC.

It is submitted that the petitioner has not lodged any formal complaint as regards the coercion to join a rival political party. It is also submitted that

the petitioner might be absconding out of fear of arrest in connection with Belda PS Case No. 555/22. It appears that after the aforesaid FIR No.

555/22, Belda Police Station received an email from the petitioner on February 17, 2023, which was registered as FIR No. 100/23 dated February 20, 2023 under Sections 448/341/325/506/34 of the IPC.

Ms. Samanta, counsel for the petitioner now submits that the petitioner has obtained anticipatory bail in respect of FIR No. 555/22.

If the petitioner surrenders, he shall be bound by the terms and conditions on which the anticipatory bail has been granted to him.

The petitioner shall be escorted back into his residence after producing the order of the anticipatory bail.

It is ordered that the investigation into the FIR No. 555/22 dated 16.12.2022 and FIR No. 100/23 dated 20.02.2023 is completed expeditiously as possible.

With the aforesaid directions, WPA 4234 of 2023 shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
