Mr. Ranojit Roy Mr. Indra Prosad Mullick ..for the petitioner This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge,1st Court at Alipore to dispose of the Matrimonial Suit No.331 of 2022. After going through the order sheets appended to this application this Court finds that a Misc. Case No. 205 of 2025 is pending. The petitioner herein who is the opposite party in Misc. Case No. 205 of 2025 was directed to file written objection and to file affidavit of assets and liabilities by both the parties. It is now well settled that an application for alimony pendente lite has to be heard and disposed of prior to the hearing of the matrimonial suit.

In view thereof, C.O. 661 of 2026 stands disposed of by requesting the learned Additional District Judge,1st Court at Alipore, 24 Parganas (South) to make an endeavour to dispose of the Misc. Case No. 205 of 2025 as expeditiously as possible. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
