Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioner is aggrieved by the fact that in spite of informing the Inspector-in-Charge, Narendrapur Police Station, till date no case has been registered, although she has claimed that her signature has been forged and a fake loan account has been prepared at the behest of Hinduja Housing Finance.

State has submitted a report which reflects that G.D. Entry has been recorded which reflects that in spite of demand of documents from the petitioner, no documents were handed over to the police authorities.

Learned advocate for the petitioner has referred to a communication made by the Arbitrator to the petitioner.

The petitioner refers to a particular communication dated 11.02.2020 which the

petitioner claims was handed over to the police authorities and in spite of the same, no action has been taken. In view of the police authorities not having taken any action and the information was furnished more than a year ago, the petitioner is granted liberty to approach the jurisdictional Magistrate under the relevant provisions of Section 156(3) of the Code of Criminal Procedure/175(3) of BNSS. The learned jurisdictional Magistrate would assess regarding the nature of the accusations as to whether the same makes out any cognizable offence, ascertain as also whether a case for investigation is made out and thereafter exercise his discretion in accordance with law.

With the aforesaid observations, the writ petition being WPA 4325 of 2024 is disposed of. There will be no order as to costs.
