Mr. Tapas Kumar Dey ..for the State The allegation of the petitioners that respondent nos. 8 to 13 have constructed their residential houses without any sanctioned plan does not merit consideration.

Insofar as respondent no. 8 is concerned, it appears that his house was constructed under a poverty alleviation scheme introduced by the State. Such construction does not require any sanction in view of the first proviso to Rule 19 of the West Bengal Panchayat (Gram Panchayat Administration) Rules, 2004.

Let the permission granted by the Panchayat and the document evidencing that the house of respondent no. 8 was constructed under a poverty alleviation scheme be kept with the records.

Insofar as respondent nos. 9 to 13 are concerned, it appears that each of them has constructed his respective house after obtaining permission from the concerned Panchayat.

Let the permission papers issued by the Panchayat in favour of respondent nos.9 to 13 be kept on record.

Accordingly, WPA 4288 of 2025 is dismissed.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
