Learned advocate for the petitioner submits that petitioner is in custody since 24th March, 2025, as such he has been detained for more than 12 months. It has been submitted that although charge has been framed, witness action has not yet commenced and there are 37 witnesses relied upon by the prosecution and there being no possibility of the trial concluding in near future, petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that there has been recovery of Rs. 7,00,000/- from the House of the present petitioner.

Having considered that 37 witnesses have been cited by the prosecution, I direct the learned Trial Court to give precedence to CSW 8, CSW 9 and CSW 10 and CSW 11, who should be examined within a period of 5 months from the next date fixed.

Petitioner would be at liberty to approach this Court after the evidence of the said witnesses is over. At this stage, I am not inclined to release the petitioner on bail.

Accordingly, CRM (M) 535 of 2026 is dismissed with the aforesaid observations.
