It is submitted that the impugned order in this proceeding under Article 227 of the Constitution of India was the subject matter in a writ proceeding being W.P. 61 of 2014. The writ petition has been decided in favour of the ICICI Bank Limited & Another on 12.8.2016 and there is nothing left to be adjudicated in this proceeding pending before this Court particularly when the petitioner has accepted the said order of Hon'ble Justice Sanjib Banerjee passed in the writ petition.

Be that as it may, the matter was taken up for consideration on 06.6.2023 when the petitioner was found absent.

Today also the petitioner is not represented. The conduct of the petitioner is eloquent enough to indicate that the petitioner has lost his interest in the proceeding.

Under such circumstances, I do not find any reason to adjourn the matter suo moto further and thereby to keep the matter pending.

Matter appears to have become infructuous and is thus disposed of.
