Learned advocate for the petitioners submits that the petitioners are in custody since 25th October, 2019 and there has hardly been any progress of the case.

Mr. Anwar Hossain, learned advocate, who ordinarily appears on behalf of the State is directed to appear and represent on behalf of the State for assistance of this Court. His appearance may be regularised by the concerned authorities. Having regard to the anxiety of the present petitioners and the facts which have been brought to my notice that the charge has already been framed and next date has been fixed on 10th January, 2022 for the purposes of fixing the schedule, I direct the learned special court to fix schedule at least once in every sixty days, three dates each, so that trial can be taken to its logical conclusion within a reasonable period of time. Learned court is further directed to fix dates only after ascertaining from the learned

public prosecutor conducting the case regarding the availability of the witnesses. Charge-sheet and his accompaniments reflect that ten witnesses are to be examined and all the witnesses belong to the Government Department/Police Department. Accordingly, the public prosecutor will also ascertain from the police authorities' concerned regarding the availability of the witnesses and thereafter represent to the court for fixing the schedules. No unnecessary adjournments should be granted to either of the parties and all efforts must be taken for completing the case. With the aforesaid observations, CRR 444 of 2021 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
