73 26.02.2026 ss CRM (NDPS) 369 of 2026 In the matter of : An application for bail under section 483 of BNSS, 2023 filed in connection with Hili P.S. Case No. 91 of 2025 dated 28.04.2025 under sections 20(b(ii) (c)/27A/28 of the Narcotic Drugs and Psychotropic Substances Act.

Das ... ... for the petitioner Mr. Ikbal Kabir Mr. Shashanka Shekhar Saha ... ... for the State Learned advocate appearing for the petitioner submits that 93.41 kgs of ganja were recovered from the possession of the petitioner. There are other co-accused persons involved in the case. Petitioner prays for bail as there is no possibility of commencement of trial in near future. Petitioner is in custody for 10 months.

Learned advocate appearing for the State opposes the prayer for bail and submits that some of the accused persons are absconding which is causing on delay in progress of the case. Prosecution is exploring efforts to trace out absconding accused.

Having considered quantum of recovery, I am of the opinion that rigors under Section 37 of the NDPS Act is

attracted. As such, the prayer for bail of the petitioner in CRM (NDPS) 369 of 2026 is rejected.

However, trial Court is directed to expedite the process of law and if warranted split up the trial of the case. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
