Shreya Basu v. State Of West Bengal
CRM (DB) 654 of 2022 08.03.2022 Sl. 77 Court No.29 Suvayan In Re: - An application for cancellation of bail under Section 439 (2) of the Code of Criminal Procedure.
And In the matter of: Shreya Basu ....petitioner.
Mr. Aviroop Bhattacharya ... for the petitioner.
Petitioner seeks cancellation of the anticipatory bail granted by the Sessions Judge by Order No.02 dated December 22, 2021. In answer to a query of the Court, learned Advocate appearing for the petitioner submits that the petitioner seeks cancellation of such anticipatory bail on the ground that the private opposite party was holding out threats to the petitioner. The petitioner could not lodge any complaint with the police with regard to such threats in view of the fear of the private opposite party.
The petitioner could approach an Advocate for the purpose of applying for cancellation of bail. Yet, the petitioner could not approach the police nor did the Advocate filing the present application advised the petitioner to lodge a complaint with the police with regard to the socalled threats received by her. In absence of any material to suggest that the petitioner received any threat, the allegations cannot be accepted. That apart, we find no ground to interfere with the order granting the anticipatory bail. The order grants interim bail with a report being called for. We are not informed as to the order dated March 7, 2022. In such circumstances, C.R.M. (DB) 654 of 2022 is dismissed. (Debangsu Basak, J.) (Bibhas Ranjan De, J.)
