The husband of the petitioner who was the Headmaster of Basantpur Jhareswar Bani Bhawan (H.S) School has been put under suspension for his alleged involvement in a criminal case.

The grievance of the petitioner is that her husband is not getting the admissible subsistence allowance.

Serious dispute as to the maintainability of the writ petition at the instance of the petitioner is being raised by the respondents.

Mr. Mukherjee, learned advocate for the petitioner submits that his client, instead of going into such a controversy, intends to withdraw the present writ petition with liberty to file a writ

petition through her husband for the self-same relief.

Mr. Mukherjee files written instruction of his client to withdraw the writ petition, let it be kept with the record.

In view of such stand of the petitioner, W.P.A. 4054 of 2022 is dismissed as withdrawn without any order as to costs.

It is made clear that this order will not prevent the husband of the petitioner to file a writ petition for the same relief on the similar ground. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
