Ghosh ... ... for the petitioner Mr. Kaushik Kundu Ms. Sima Biswas ... ... for the State Learned advocate appearing for the petitioner submits that the total recovery in the case is 24.68 kgs of ganja from the joint possession of the petitioner and three others. Similarly placed accused persons have been granted bail in CRM (NDPS) 843 of 2025 and CRM (NDPS) 286 of 2026. Learned advocate appearing for the State opposes the prayer for bail.

I have taken into account the locus of the present petitioner who is similarly situated with other accused persons. Having considered the same, I am inclined to release the petitioner on bail.

The petitioner shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two

sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act cum Additional Sessions Judge, Murshidabad at Berhampore. If on bail, the petitioner shall be physically present on each and every date fixed before the learned trial court and shall not leave the district of Murshidabad without the prior permission of the learned Special Court. Accordingly, CRM(NDPS) 370 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
