Petitioner submits that the evidence of PW-11 who is a doctor was closed without any fault on behalf of the petitioner as the conducting learned advocate of the petitioner prayed for adjournment on the ground of his illness. The witness was a doctor who was posted at Calcutta and went to Bankura for being testified as a witness in connection with S.C. No.07 of 2022. Having regard to the factum that for the ends of justice the doctor is required to be examined, I am inclined to grant an opportunity subject to payment of cost of Rs.10,000/- by the petitioner. Learned trial court would before the evidence of the investigating officer commence grant an opportunity to the petitioner on a single day to cross-examination PW-11. The cost be deposited with District Legal Services Authority, Bankura and the receipt submitted before the trial court. With the aforesaid observations, CRR 711 of 2024 is disposed of.
