1. Calcutta Municipal Corporation is represented by the learned advocate.

2. In pursuance of the direction, a report was submitted on previous occasion by the learned Registrar General, High Court at Gujarat indicating that during pendency of this appeal, the respondent/accused no. 2, Mohon Lal Reva, has already been expired. A photocopy of certificate of death of the said respondent no. 2 was annexed with the report.

3. The instant appeal was preferred at the behest of the appellant/corporation challenging the impugned judgment and order of acquittal passed by the learned Trial Court dated 04.06.1992. As the sole accused/respondent no. 2 has already

been expired during pendency of this appeal, the instant appeal stands abated against him.

4. I have perused the impugned judgment and order of acquittal passed by the learned Trial Court and I find nothing materials to interfere with it.

5. Accordingly, the instant appeal be and the same is hereby dismissed on merit.

6. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities. (Prasenjit Biswas, J.)
