The report filed by the Superintendent of police, Krishnangar Police District dated 29.05.2023 be kept on record. From the report it appears that the appellant has already served out the sentence from the event mentioned in the report. Learned advocate for the State submits that including remission period the appellant must have served out the sentence.

This appeal filed in 2009 is still pending for admission. It appears from orders dated 23.12.2009 and 13.03.2023 that this court gave direction to the appellant to remove the defects. The appellant has filed Section 5 application which is pending since last fourteen years.

None appears for the appellant even today on call to move this application. The appellant is no longer interested to proceed with the appeal.

Accordingly, this appeal is not admitted and disposed of. (Ananya Bandyopadhyay, J.)
